What is Dumping?
The definition of Dumping is when a product is sold for export for a price that is below that product’s home market value or below its cost of production. An antidumping duty order can be filed if a U.S. industry is injured by such dumping. The U.S. Department of Commerce (US DOC) makes a determination with regard to whether the dumping actually exist; Simultaneously, the U.S. International Trade Commission (US ITC) conducts an investigation to determine whether that dumping causes material injury or threat of material injury to the domestic industry. If it is determined that the dumping is occurring and that there is a potential of material injury, the antidumping order will be imposed. If there is an antidumping order that is issued from the preliminary affirmative determination of the US DOC and USITC, the U.S. Customs and Border Protection (US CBP) will enforce and collect duties in amounts that are equivalent to the dumping margins.
